Liability Waiver & Release

1. Assumption of Risk

I understand and acknowledge that participation in pickleball and related activities organized by Ladder League involves inherent risks of physical injury, including but not limited to:

• Muscle strains, sprains, and tears
• Broken bones and fractures
• Concussions and head injuries
• Joint injuries (knees, ankles, wrists, shoulders)
• Eye injuries from ball impact
• Heat-related illness (heat exhaustion, heat stroke)
• Slip and fall injuries on court surfaces
• Injuries from contact with other players, paddles, balls, nets, or court structures
• Aggravation of pre-existing conditions
• In rare cases, severe injury, permanent disability, or death

I voluntarily assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable.

2. Waiver and Release of Liability

In consideration of being allowed to participate in Ladder League activities, I hereby waive, release, and forever discharge the following parties from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, loss, damage, or death that may occur as a result of my participation:

• Ladder League and its owners, operators, officers, directors, and employees
• League organizers, administrators, and volunteers
• Court owners, operators, and property managers
• Other players and participants
• Sponsors and affiliated organizations
• Any agents, representatives, or assigns of the above parties

This release applies regardless of whether such injury, loss, damage, or death is caused by the negligence of the released parties or otherwise.

3. Court Facilities Disclaimer

I understand that Ladder League does not own, operate, maintain, or inspect any court facilities used for league play. I acknowledge that:

• Courts listed on the Ladder League website are owned and maintained by independent third parties
• Ladder League makes no representations or warranties about the condition, safety, or suitability of any court facility
• I am responsible for inspecting court conditions before playing and refusing to play if conditions are unsafe
• I assume all risk related to the condition of court surfaces, nets, fencing, lighting, and surrounding areas

4. Medical Acknowledgment

I represent that I am physically fit and have no medical condition that would prevent my safe participation in pickleball activities. I understand that Ladder League does not provide medical personnel or services at any league events. I agree to seek my own medical attention if injured and understand that I am solely responsible for any medical costs incurred.

I authorize emergency medical treatment in the event that I am unable to provide consent due to injury or incapacity.

5. Indemnification

I agree to indemnify, defend, and hold harmless Ladder League, its owners, operators, officers, employees, agents, court owners, volunteers, and all other released parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) that may arise from my participation in the league, my use of any facilities, or any breach of this waiver.

6. Photo and Video Release

I grant Ladder League permission to use photographs, video recordings, and other media of my participation in league activities for promotional purposes, including but not limited to social media, the website, and marketing materials. I waive any right to compensation for such use.

7. Weather and Environmental Conditions

I understand that outdoor league activities may be subject to weather and environmental conditions including extreme heat, cold, rain, wind, and poor air quality. I accept responsibility for monitoring conditions and making my own decisions about participation. Ladder League may cancel or reschedule activities due to weather but is not obligated to do so.

8. Personal Property

I understand that Ladder League, court owners, and other released parties are not responsible for any loss, theft, or damage to my personal property (including vehicles, equipment, electronics, and personal belongings) while attending or participating in league activities.

9. Binding Agreement

This waiver is intended to be as broad and inclusive as permitted by the laws of the State of Utah. If any portion of this waiver is found to be invalid or unenforceable, the remaining portions shall continue in full force and effect.

This waiver shall be binding upon me, my heirs, executors, administrators, and assigns.

10. Governing Law

This waiver shall be governed by and construed in accordance with the laws of the State of Utah. Any disputes arising under this waiver shall be resolved through binding arbitration in Salt Lake County, Utah.

11. Electronic Acceptance

By checking the box during account registration confirming that you have read and agree to this Liability Waiver & Release, you are providing your electronic signature and consent to this agreement. This electronic acceptance has the same legal force and effect as a handwritten signature.
